Questions about the Tentative Agreement:
A: The 1-year renewal will be a continuation of partnership between the Association of Canadian Advertisers (ACA) and ACTRA.
A: A 1-year renewal makes it possible to continue providing stability for the industry and continued work opportunities for ACTRA members with non locking out engagers.
A: The Institute of Canadian Advertisers (ICA) continues to lock-out ACTRA Performers and refuses to engage them under the NCA. ACTRA continues its fight at the Ontario Labour Board against the ICA and its advertising agencies. ACTRA remains willing to return to the bargaining table at any point.
A: It means that the existing 1-year NCA Agreement term will extend for a period spanning from ratification date to May 31, 2025.
A: Yes. Upon a successful ratification vote, ACTRA members will see an immediate 5% increase to all minimum fees and rate.

A: Yes. Upon a successful ratification vote, ACTRA members who work under the L&R will see an immediate 5% increase to all minimum fees and rates.

A: Yes. The Bundle rates will be subject to the same immediate 5% increase.

A: Contract Service Fees (CSF’s) have been simplified and clarifying language has been added to article.
A: No. We will be in a strong position to achieve effective AI terms and conditions in the upcoming Independent Production Agreement (IPA) negotiations that can then be negotiated into all Agreements. In the interim, a commitment has been made by both Parties to meet no less than quarterly to discuss and review information related to Generative Artificial Intelligence (GAI) forms part of these terms of settlement.
A: There have not been any changes to these terms, they are being inserted to provide clarity. The ACA requested that terms from the previous Memorandum of Agreement from June 1, 2023 to May 31, 2024 be included in this Memorandum of Agreement.
A: Firstly, CSF’s do not impact a Performer’s rate. CSF’s have now been simplified to provide one rate for TV/Digital Video Commercials and one rate for Audio/Digital Commercials. Historically, there have been lower rates for Digital Media commercials and the language and calculations for determining the CSF payment to be remitted were unnecessarily complex.
A: Either party may give notice to the other party at least eight (8) months prior to the expiration date of this Agreement.
Full members in good standing must have an attachment to the workplace by having worked under the ACTRA ICA/ACA NCA agreement between July 1, 2020 to May 31, 2022, or under the ACA-ACTRA agreements between June 1, 2022 to March 31, 2024.
Subject to Article 1102 of the Constitution, an Apprentice Member will have a right to cast a ballot in the ratification vote when the ACTRA Membership System (AMS) shows that they have completed 2 professional engagements in a residual category under the ACTRA NCA agreement between ICA/ACA NCA agreement between July 1, 2020 to May 31, 2022, or under the ACA-ACTRA agreements between June 1, 2022 to March 31, 2024.
Subject to Article 1102 of the Constitution, an Apprentice Member will have a right to cast a ballot in the ratification vote when the ACTRA Membership System (AMS) shows or they have submitted proof satisfactory to the ACTRA Branch/Local Union that they have worked in Background roles for at least 8 work days per year under the ACTRA NCA agreement between ICA/ACA NCA agreement between July 1, 2020 to May 31, 2022, or under the ACA-ACTRA agreements between June 1, 2022 to March 31, 2024.
Subject to Article 1102 of the Constitution, an ACTRA Additional Background Performer will have a right to cast a ballot in the ratification vote when the ACTRA Membership System (AMS) shows or they have submitted proof satisfactory to the ACTRA Branch/Local Union that they have worked in Background roles for at least 15 work days per year under the ACTRA NCA agreement between ICA/ACA NCA agreement between July 1, 2020 to May 31, 2022, or under the ACA-ACTRA agreements between June 1, 2022 to March 31, 2024.
Questions regarding the current status of the ICA Lockout:
A: The Lock-out of ACTRA Performers continues. ACTRA continues to fight to end the lock-out, including at the Ontario Labour Relations Board. ACTRA remains committed to returning to the bargaining table at any time.
A: On May 17, 2022, ACTRA filed an Unfair Labour Practice Complaint with the Ontario Labour Relations Board (OLRB) as a result of the bad faith bargaining of the ICA and its advertising agencies and have been involved in this lengthy process ever since. We thank the members who have been called to testify at the hearings or showing up as observers to lend their support to the cause. Additional hearing dates are scheduled up until December this year.
